NOTICE OF PUBLIC HEARING
TOWN OF NELSON
NOTICE IS HEREBY GIVEN that, pursuant to Municipal Home Rule Law and Town Law, there has been presented to the Town Board of the Town of Nelson, New York, at a regular meeting thereof held on December 12, 2024, proposed Local Law No. H-2024, titled, “A Local Law to Amend the 2011 Town of Nelson Land Use and Development Law to Prohibit Tier 2 and Larger Battery Energy Storage Systems.” Said Local Law, if enacted, will prohibit the establishment, placement, installation, construction, and erection of certain battery energy storage systems in the Town of Nelson in a manner that preserves the health, safety and welfare of the Town while also facilitating the production of renewable energy. The full text of said Local Law is on file at the Town Clerk’s Office at the Nelson Town Office located at 4085 Nelson Road, Cazenovia, New York 13035 for inspection by all interested persons.
NOTICE IS FURTHER GIVEN that on December 12, 2024, the Town Board determined that this proposed Local Law is a Type I Action in connection with SEQRA, determined that the Town Board will act as lead agency in this matter and issued a negative declaration under SEQRA.
NOTICE IS FURTHER GIVEN that the Town Board will hold a public hearing on the proposed Local Law at the Nelson Town Office located at 4085 Nelson Road, Cazenovia, New York 13035 on January 9, 2025 at 6:30 p.m., or as soon thereafter as the matter can be heard, at which time all persons interested will be heard.
